The monitoring petition challenging the order dismissing the complaint filed in the ACJM court against Congress MP Rahul Gandhi was accepted. Special judge of MP-MLA court Harbansh Narayan quashed the order of ACJM court. Also ordered to hear the case again and issue orders.
Let us tell you that by filing the petition, monitor Nripendra Pandey had said that Rahul Gandhi had said derogatory things against Veer Vinayak Damodar Savarkar in a press conference during Bharat Jodo Padyatra. After this, an application was filed in the court demanding a report against Rahul. It alleged that as a well-planned strategy, Rahul Gandhi in Akola, Maharashtra, on 17 November 2022, criticized Veer Savarkar on a public platform without any reason to spread enmity.
It has also been said in the application that Rahul has made many allegations against Veer Savarkar by calling him a pensioner and servant of the British, a helper and an apologist for his release. In this way Rahul has insulted all the freedom fighters of the country. The ACJM court had earlier ordered to register this application as a complaint. However, later on June 14, 2023, the ACJM rejected that complaint, terming it as outside the jurisdiction. This order of the lower court was challenged through a monitoring petition. After hearing it, the MP-MLA court found that the ACJM had committed an error in rejecting the complaint.
